Jackson McDonald’s Real Estate team has a long history of providing legal services to the local property market and to interstate and international entities looking for premises or to invest in property in Western Australia.

We understand the issues that clients may face from extensive experience of working across various industries regarding regulatory and environmental approval processes for land development, comprehensive due diligence, and contract and/or lease negotiations.

We in turn provide our clients with guidance through the approvals and appeals process; commercially focused contracts and agreements on time; value for money and timely support to expedite outcomes; and where practicable, introductions to expert technical advisers who may be able to assist.

Acquisition and Disposal of Property

In the past 18 months, Jackson McDonald has been dominant in the area of office building acquisitions and disposals with the Real Estate Group acting on, the acquisition of five CBD office buildings with an average market value of $40 million; and the disposal of two CBD office buildings with an average market value of $60 million.

  • We acted for a lifestyle village operator in relation to the purchase of site for the development of a minesite accommodation village. We provided advice regarding structuring and due diligence.

  • We have acted for Primewest in relation to the acquisition of 251, 256 and 267 St Georges Terrace respectively. Jackson McDonald was responsible for, conducting due diligence, drafting and negotiating a call option deed, drafting and negotiating the sale contract, and attending on and effecting settlement.

Leasing

We act for numerous clients in the retail, office, industrial and commercial property sectors; both landlords and tenants. Jackson McDonald has extensive experience acting for various State Government Departments (as both landlord and tenant) in relation to major leasing transactions.

  • We have acted for the National Trust (WA) in relation to the drafting and negotiation of leases with respect to Crown Land Titles in various locations across Western Australia.

  • We have recently acted for a private property developer in relation to an office development of over 6500 square metres in Osborne Park. We negotiated the Agreement for Lease and Lease documents with the anchor tenant, a State Government Department.

  • We recently assisted a major resources company in relation to a long term lease of part of the Perth Airport industrial precinct for a remote operating centre. Jackson McDonald was responsible for drafting and negotiating the terms of the Agreement for Lease and Lease.

Environment

Contaminated Sites Act

  • We have acted for a range of industrial landowners and tenants in respect to site classification, and reporting and compliance obligations under the Contaminated Sites Act 2003 (WA).

  • We have acted for an international oil company in respect to its WA retail service station outlets, dealing with a range of contaminated sites arising from service station and bunkering usage.  Working with our client and environmental consultants we successfully negotiated the remediation protocols in respect of a range of sites and prosecuted appeals.
