Our Projects, Infrastructure & Construction team has an in-depth understanding of the complex construction industry and its key players in Western Australia. As one of the largest and most established in WA, with four Partners, one Special Counsel and three Senior Associates, we have a dedicated Construction team of lawyers and support staff.

Having acted for principals, developers, contractors, consultants and subcontractors we know and understand the drivers that influence successful projects and what it takes to achieve results.

We have extensive experience in contract drafting at all levels, dispute resolution and involvement in local, national and international construction and construction law bodies. We are actively involved in many construction related bodies, such as the Society of Construction Law Australia, Law Council of Australia, Consult Australia and the MBA.

Our experience ranges from domestic construction to major commercial and infrastructure projects, onshore, coastal and offshore, and includes contracts relating to the procurement of plant, equipment and services for the energy and mining industries, ports, government and private developments.

  • We have advised an EPC Contractor on a range of construction documentation for the construction of two power stations in Western Australia and Queensland respectively, with aggregate contract values in excess of $1 billion.

  • We have drafted and negotiated contracts for the two main service providers operating Floating Production Storage and Offloading (FPSO)facilities off the coast of Western Australia.

  • We have advised a government department in relation to a major inner city infrastructure project, advising on procurement documentation; two stage managing contractor contract; all professional consultancy appointments and other construction documentation including guarantees, bonds and deeds.

  • We have drafted the full suite of construction and engineering contracts required for the major extension undertaken by a port authority to its port facility, including advice on an innovative two stage tendering process and all ancillary construction documentation.

  • We have acted for a government department in relation to the construction and redevelopment of a suburban railway station and surrounding area, incorporating the sinking of the railway line. The value of works was in excess of $50 million. 

  • Acting for a national building company, we have developed with them a suite of key documents used in relation to the contracting for supply and installation of prefabricated homes throughout the country. 

  • We have acted for an international principal upon the multi-million dollar arbitration involving claims arising out of the construction of a power station.

  • We have acted for a government department in drafting and negotiating the design contract for a new $50 million hospital in the south west of Western Australia. 

  • We have acted for professional architectural consultants on a variety of appointments in the healthcare sector including several of the most recent hospital projects in Perth.

  • We act as primary lawyers coordinating the provision of a full range of legal services to multi-nationals involved in the energy (oil, gas and coal) and mining sectors in connection with their Western Australian operations and to many who provide goods and services to these industries.  We are involved in advising multi-nationals on procurement contracts for many of the major energy infrastructure projects both at the planning stage and where construction is already under way.

  • We have advised a national contractor on its multi-million dollar claims for additional cost and expense arising out of the construction of a $300 million railway infrastructure project for one of the country’s major mining companies.

  • We have acted on a series of multi-million dollar rapid adjudication disputes for a Principal arising out of the construction of a mine and its associated infrastructure including railways and automated plant.
